Typical Arraignment Linear Flow of Events
- Suspect (defendant) is given a written accusation prepared by a prosecutor’s office.
- Defendant is now allowed to apply for court-appointed defense counsel.
- Defendant responds to the written charges, usually orally and almost always with a “not guilty” plea.
- Judge will set a tentative date for later courtroom proceedings; pretrial conference, preliminary hearing, hearing on pretrial motions, and the actual trial date.
- Judge decides unresolved bail issues (bail may be set, raised, or lowered; or the defendant may be released on his own recognizance.
